How to change a tourist visa to a Religious R1 visa while I am in USA?
Q. I have a B1/B2 visa valid for 10 years. I want to change this visa status to R1 whilI am in USA. I am professional graduate in Religious education and had been ordained and in the occupation for the past 6 years in India.

A. If the person seeking R-1 status is present in the US in a valid nonimmigrant category (other than "visa waiver") the prospective employer may file an R-1 petition with the CIS. The application for R-2 status for family dependents is filed at the same time. The processing time for an R-1 petition varies between 1 to 5 months. You would not be able to participate in R-1 activities until the petition is approved because an approval cannot be assumed. Employee Requirements: The beneficiary must be qualified to work in the religious occupation. Ministers must have the required seminary degree and or ordination certificate. What type of US visa a foreigner would need to run his own US company?
Q. For a foreigner that opens an LLC in the US (and a foreigner could legally do that), what type of temporary visa would he need to be able to stay in the US for a limited amount of time managing the company? And we're talking small business, so the investor visas won't do it, they require larger investments. Thanks Chuckles for your answer, yes, the company might as well be opened as a branch for a foreign company.

A. If the business in the USA is the branch office of a foreign company they can get an "L" class visa to do this. There are various levels for doing this. However, if there is no foreign parent company then you need an investor visa and make an investment of an appropriate size.

A. The quota for H-1 visas for 2007 has already been filled. I think you can start your own business and get a tax ID no for it, you just wont be able to be employed by your own business. However as long as that business pays it's taxes I'm fairly sure as the sole propreitor of that business you can spend the profits on whatever you would like, if you get my drift. I advise looking into the rules at uscis.gov.
